New Record for WCMSA -20 days approval
I am pleased to announce that our company recently set a record for the quickest approval of an MSA by CMS. It took only 20 days. If CMS was always this efficient, everyone would be a lot happier with the system.

NEW CMS POLICY MEMO
CMS released a new policy memo regarding life expectancy tables. CMS is going from two LE tables to one effective July 1, 2009. See link for the text of the memo.
This is not a big issue, but it can affect WCMSAs that are prepared before July 1 using the old tables and submitted after July 1, when CMS expects everyone to use the new tables.
I have received two calls on this memo already. In both instances the caller asked if this meant that CMS was no longer allowing rated-ages. This memo does not mean that. It just changes the LE table to use in conjunction with the rated-age.

Big News: New Legislation

Late last month the Federal Govt greatly expanded the Medicare Secondary Payer Act that is going to affect Medicare Set-asides, workers comp and general liability cases. What the government is going to create is a reporting requirement for the settlement of WC cases and GL cases where the claimant/plaintiff is on Medicare. The carrier will be responsible for ascertaining Medicare status.
After settlement the carrier will have a reasonable amount of time to report the terms of the settlement to the government. Failure to do so will result in a fine of $1,000 per day. That is correct per day.
All of the parameters are to be worked out by the Sec of HHS over the next 18 months. The law will go in to affect in July of 2009.
The big news, of course, is that the government is going to be monitoring GL cases. This means that the parties would be foolish to submit settlement information without containing a Medicare Set-Aside.
