New Bill introduced to affect MSAs
Welcome to Business Insurance
HR Bill 2549 was introduced last week by two Democrats and two Republicans. The link does not contain the entire text of the bill. I have read the bill, however. It is exactly the same bill that was introduced last year (which died in committee). It would eliminate the need for MSAs in WC that settled for less than $250,000. We all know that this would represent the vast majority of cases. I would guess that less than 1/2 of 1% of WC cases settle for in excess of $250,000.
The bill was drafted by and backed by big business. Essentially it makes the Medicare Secondary Payer act meaningless and shifts the responsibility of WC related injuries back to Medicare (and the tax payers). I doubt once Congress takes a closer look at this that it will be willing to eliminate this source of expense reduction for Medicare.
